Statement of Individual Rights
An individual who reports an alleged violation of the sexual harassment is entitled:
- To be treated with respect by college officials.
- To be made aware of available options.
- To take advantage of campus support resources.
- To experience a safe living, working, and educational environment.
- To be made aware of options that are available including support resources, remedial actions, timeframe to file a complaint and resolution options.
- To be advised of the status of an investigation, remedial actions that have been taken, preparations for an on-campus hearing, the outcome of a hearing and, if necessary, assessed sanctions, whether an appeal has been filed and/or the outcome of an appeal.
- To have an advisor present for all meetings and proceedings.
- To have irrelevant prior sexual history (rape shield)Â disallowed in a Luther College Hearing Board hearing.
- To refuse to have an allegation resolved through alternative resolution procedures
- To be provided amnesty for minor misconduct that is ancillary to the incident that is a violation of this policy.
- To be free from retaliation.
An individual accused of allegedly violating the sexual harassment policy is entitled:
- To be treated with respect by college officials.
- To take advantage of campus support resources.
- To experience a safe living, working, and educational environment.
- To have an advisor present during all meetings and proceedings.
- To be advised of the status of an investigation, remedial actions that have been taken, preparations for an on-campus hearing, the outcome of a hearing and, if necessary, assessed sanctions, whether an appeal has been filed and/or the outcome of an appeal.
- To have irrelevant prior sexual history (rape shield) disallowed in a Luther College Hearing Board hearing.
- To refuse to have an allegation resolved through alternative resolution procedures. (not applicable to employee respondents)
- To be heard in accordance with the Luther College Policy and Procedures
